General Terms

This Terms of Use is an agreement between Users (“You”) and GROW (“We”), a limited liability company duly established and legally operating under the laws of the Republic of the Union of Myanmar. This Terms of Use governs your access and use of the app, website www.growfi.ai and other websites we manage), content, and products provided by us (hereinafter, collectively referred to as “Application”), as well as order, payment, or use of the service available on our Application (“Service or Services”).

We reserve the right to replace and modify the terms herein at any time and at our sole prerogative. 

By using our App and this Website, you accept the contents of these Terms and Conditions, the Privacy Policy, and other policies found on this Website.  By agreeing to this Terms of Use, you also agree to additional Terms of Use, including the Terms of Use of each Service, and changes that are an integral part of this Terms of Use (hereinafter, the Terms of Use, additional terms of Use and its changes are collectively referred to as “Terms of Use”). Notwithstanding the inseparability, the additional Terms of Use supersedes the Terms of Use in case of any discrepancies among them.

The information found herein is on an “as is where is” basis. Despite the exercise of diligence, the information may have errors. Any reliance on the contents of this App and Website is at the users’ own risk. Any loss or injury arising from any use and non-use of the information contained herein shall not be compensated by us.

By using our Application, website, or our services, you are deemed to have consented to the processes mentioned below.

Use of Application and Services

Your access and use of the application are subject to this Terms of Use. 

You have full discretion either to use the application or other apps, whether to use services available on the Application or to stop using the application. 

We only facilitate you finding various services you need by providing the application. All Services are provided directly by independent third parties who agreed to become our partners and users (“Partners”, “Users”).  (i) We are not the representative of the Partners nor the Users; and (ii) the Partners are not our employees; 

When ordering a service, the application will connect you with the available partners around your location. Thus, some of our services cannot be used if you do not activate the location feature.

Furthermore, if a partner accepts your order, we will inform you of your order status through the application.

Since we are a privately owned business, we reserve the right to refuse to provide service to you subject to the limits imposed by applicable laws and regulations.

Application Software

We only provide official application software on official digital markets, such as Google Play Store or Apple App Store, and use on mobile phones or tablet devices only. Downloading the application from platforms other than official digital markets and/or to devices other than mobile phones or tablets violates these Terms of Use and our intellectual property rights. When this occurs, we may terminate or suspend your use of the App or Website and forfeit any payments you made.

Signing-up and Signing-in Grow Account

Before using the application, you must agree to this Terms of Use and Privacy Policy and register yourself by providing the information we need. When registering, we will ask you to provide the personal information required as part of the registration process, like your full name, NRC details, and phone number. You may change your profile information on the settings feature in the application. 

After registering, our system will automatically generate a verification code and send the verification code via a text message to the mobile phone number you provided. You have to verify your identity by entering the verification code on the registration page in the Application.

After verifying, our system will create a personal GROW account (“Account”) for you to use the application and order services through the application. Your mobile number is ascribed to your account, so you cannot create a new account with a registered mobile number. The same is true if you later change your mobile number in the settings feature in the application.

In the event that you have been logged-out from your account, then you need to enter your electronic mail address or mobile phone number you provided when registering yourself and enter the verification code, which is then automatically sent by our system to your registered mobile phone number, on the log-in page.

THE VERIFICATION CODE (ONE TIME PASSWORD/OTP) IS PRODUCED AUTOMATICALLY BY OUR SYSTEM. WE DO NOT KNOW AND NEVER ASK FOR YOUR VERIFICATION CODE. NEVER PROVIDE THE VERIFICATION CODE TO ANYONE EVEN TO US OR OTHER PARTIES WHO ACKNOWLEDGE THEMSELVES AS OUR REPRESENTATIVES.

Device Authentication Features

If you are using a device that supports fingerprints and/or facial recognition features, you can enable such device authentication features for logging in to our application.

When you are enabling the fingerprints and/or facial recognition features in your mobile device for authentication purposes in your application, please note that we do not store such biometric data. Unless otherwise notified to you, such data is stored in your mobile device and may also be stored by third parties, such as your device’s manufacturer. You agree and acknowledge that we are not responsible for any unauthorized access or loss of such biometric data which is stored in your mobile device.

If you are changing your mobile device, an OTP will still be required for you to log in to the application. If you wish to enable the device authentication feature in your new device, you can do so in your device settings.

Your Account

Your account can only be used by you and cannot be transferred to other people for any reason. We reserve the right to refuse to facilitate orders if we know or have sufficient reason to suspect that you have transferred or allowed your account to be used by someone else.

The security and confidentiality of your account, including registered name, electronic mail address, registered mobile number, payment details and payment methods you choose, as well as verification code generated and sent by our or payment method provider’s system are fully your personal responsibility. All losses and risks arising from your negligence in maintaining such security and confidentiality are borne by you. In such cases, we assume any use or order made through your account as your legitimate request.

Immediately notify us upon knowing or suspecting that your account has been used without your knowledge and consent. We will take actions we consider necessary and we may do toward that unconsented use.

Orders

When you place an order, we will confirm your order by sending you an app notification. Where applicable, orders will include delivery fees, applicable tax, and other charges (e.g. goods and service tax, value-added tax, etc.) Please note that your order may be subject to additional terms & conditions provided by the partner. You are responsible for providing the delivery address for the platform to display the partners available in your delivery area.

Placing the order

To complete an order, please follow the onscreen instructions after clicking ‘Checkout’. You may be required to review and confirm that all the information you have provided, including the amounts, delivery details, personal details, payment methods and voucher codes (if applicable) is correct, accurate and complete before you click “place order”. An order is successfully placed when you receive a confirmation containing your order receipt from us.

Canceling the order

As we intend to help the community, we would not allow you to cancel the food orders after payment. Please contact us through our  in-app customer support chat feature if you wish to cancel your craft and service order after it has been placed.

Communication on Orders

For full transparency, GROW admins can have access to the conversation between buyers and sellers based on the order placed, alongside the order details. This is for reference only, ensuring that the exchange of ideas is legal, and both parties involved adhere to the Terms & Conditions of GROW.

Refunds on Online Payment Orders

You have the right to refund for a cancelled order only if a vendor has not yet accepted your order. Should you still decide to cancel your order after it has been accepted by the vendor, you understand that no refunds (whether in whole or in part) will be issued to you and you forfeit the delivery of your cancelled order.

Rates & Fees

Our application is free to download. However, we may charge prices or fees for using certain features on applications in the future. Services available on the application are subject to the rates that you can find on the application before ordering and availing the service. We may adjust or renew rates from time to time based on certain factors such as, but not limited to, location, time, type of services, and applicable laws. Your bank transaction payment will only be charged for products/services dispatched to you. All of our products/services are zero-rated for VAT. Prices of products/services do not include delivery charges.

Gift Vouchers

Vouchers cannot be exchanged or refunded for cash
Vouchers can be used towards the purchase of goods at a higher price than their face value upon payment of the difference. No change or credit will be given for unused portions of a voucher.
GROW is under no liability for replacement or refund should vouchers be lost, stolen, damaged or destroyed whether they have been redeemed or not.
Vouchers are only valid for the amount printed next to it.

Payment Methods

When using our application, there are several payment options on checkout. You can pay by Bank Transfer. This can be arranged by uploading the payment transaction screenshot to our payment section.

We reserve the right to refuse or postpone your payment request using the Payment Method for certain reasons, including but not limited to any indication or we have sufficient reasons to suspect any fraud, deceit, violation against Terms of Use, violation against applicable laws including related to payment using cards, electronic money, payment transaction processes, anti-money laundering, corruption and terrorism financing, or any unusual or suspicious behaviour, including any obligation You have yet to fulfill to us.

Intellectual property

Application and service including but not limited to names, logos, program codes, designs, trademarks, technologies, database, business processes and models are protected by copyright, trademark, patent and other intellectual property rights available under the laws of the Republic of the Union of Myanmar which registered either on behalf of us or our affiliates. We have all the rights and interests of the application and services including all intellectual property rights related to all features contained therein and related intellectual property rights.

Delivery, Pick-up and Partner Delivery

Our partners offer their goods and services in specific delivery areas and they vary from one location to another. By entering your delivery address on the platform, you will see the partners that we make available to you at that time.

Partners will deliver to the location that we had updated at the application or you can choose the available pick-up. If you choose our delivery service, we will contact you once I have received your order to arrange a delivery time.

No-show cancellation

If you remain uncontactable or fail to receive the order within twenty (20) minutes from the time the order arrives at your delivery address, GROW reserves the right to cancel your order without refund or remedy to you.

Order pick-up

The users will have the option of collecting the order in-person directly from the partner’s premises instead of having an order delivered to you. Email/ message confirmation will indicate the time for you to pick-up your order. The partner will prepare the order by the collection time. In some cases, a reasonable delay may be expected. The partners agree to hold the order for you at the partner premises for no more than a reasonable period of (60) minutes from the collection time and shall not be obliged to provide the order to you if you fail to pick up your order within the holding time.

Partner Delivery

In some cases, our partners/service providers will deliver the order to you. Where partner delivery applies, we may ask you to contact the partner directly in the event of issues or delays in your delivery. GROW shall not be responsible in any way for orders or goods that are delivered by partners.

Partner Liability

Partner is responsible for the preparation, conditions, and quality of goods and services. In cases of partner delivery, the partner is responsible for the delivery of goods and or orders. GROW is just a platform facilitating the community. We shall not be responsible for any loss or damage arising from your contractual relationship with the partner.

We shall not be liable for any damages, direct or indirect, including loss of profits, data, goodwill, or use resulting from the use of the information provided on the Application and Website and the non-compliance with the obligations between the client and the Partner If we be held liable for any damages for whatever case, our liability shall not exceed the total amount paid by the user to access this Website.

Personal Information

You agree and consent to GROW and any of its affiliate companies collecting, using, processing and disclosing your personal information with these terms and as further described in our Privacy Policy. Our Privacy Policy is available via the links on our platform and shall form a part of these Terms.

Termination

Subject to the limitations provided for by law and regulations, GROW has the right to terminate, suspend and delete your account and access the platform including any delivery service we provide to you in respect of any order, for any reason, including, without limitation, if GROW in its sole discretion, considers your use to be unacceptable, or in the event of any breach by you of the Terms, GROW may, but shall not be under no obligation to, provide you with a warning notice prior to termination of your use of the website and applications.

Modification

Subject to this agreement, GROW reserves the right, at its discretion, to modify the terms and conditions of this agreement on its policies relating to the software or services at any point of time, effective upon posting of an updated version of this agreement through the services.

Additional Terms & Policies

By using the services, you agree to be bound by this agreement and acknowledge and agree to the collection, use, and disclosure of your personal information in accordance with GROW’s Privacy Policy, which is incorporated in this agreement by reference. You also agree to abide by any additional GROW policies for users that are published on our website or mobile application. Certain features of our services may be subject to additional terms and conditions, which are incorporated herein by reference.

Rules and Prohibitions

Without limiting other rules and prohibitions in this agreement, by using the service you agree that:

  • You will only use the services for lawful purposes; you will not use the services for sending or storing any unlawful material or for deceptive or fraudulent purposes; and you will not engage in conduct that harms other users, GROW employees or our community.
  • You will only use the service in accordance with all applicable laws, including copyrights, trade secrets, or other rights of any third party, including privacy or publicity rights.
  • You will only access the service using means explicitly authorized by GROW.
  • You will not use another user’s account, impersonate any person or entity, or forge or manipulate headers or identifiers to disguise the origin of any content transmitted through the services.
  • You will not use the service to cause nuisance, annoyance or inconvenience.
  • You will not use the services or any content accessible through the service for any commercial purpose, including but not limited to contacting, advertising to, soliciting or selling to any merchant, partners, user or contractor unless GROW has given you prior permission to do so in writing.
  • You will not use the App or the Website to gain unauthorized access to other systems, networks, and platforms.
  • You will not copy or distribute the software or any content displayed through the services including partner’s menu content and reviews for republication in any format or media.
  • You will not compile, directly or indirectly, any content displayed through the services except for your personal, noncommercial use.
  • You will not use or upload software which contains, or reasonably seem to contain, viruses, harmful date, damaging information, and others that may damage and corrupt the App or Website
  • The information you provide to us when you register an account or otherwise communicate with us is accurate, you will promptly notify us of any changes to such information, and you will provide us with whatever proof of identity we may reasonably request.
  • You will keep secure and confidential your account password or any identification credentials we provide to you which allows access to the services.
  • You will not scrape or otherwise conduct any systemic retrieval of data or other content from the services.
  • You will not try to harm other users, partners, GROW or the services in any way whatsoever.
  • You will not engage in threatening, harassing, racist, sexist or any other behavior that GROW deems inappropriate when using the services.
  • You will not abuse our promotional or credit code system, including by redeeming multiple coupons at once or by opening multiple accounts to benefit from offers available only to first-time users.
  • You will not attempt to undertake any of the foregoing.

In the event that we believe or determine that you have breached any of the terms, we reserve that right to suspend or permanently deactivate your account at our sole discretion.

Transaction involving Alcohol

You may not have the option to request delivery of alcohol products in some locations and from certain merchants. If you receive your product, you agree that you will only order alcohol products if you are of legal age to purchase alcohol products in the relevant jurisdiction. The provider reserves the right to refuse delivery if you’re not of legal age, if you cannot provide KYC and date of birth confirmation.
